boxmoments benelux (hereinafter: "boxmoments") is an online store where you can order gift boxes. boxmoments is responsible for data processing. In this privacy statement we explain which personal data boxmoments collects and uses and for what purpose. We have done our best to make this privacy statement as understandable as possible and recommend that you read it carefully.

When you use our online store, we obtain certain information from you. This could be personal data. We only store and use the personal data that you provide directly in the context of the service you have requested, or for which it is clear when provided that they are provided to us for processing. The data (texts and images) that you add to your card design(s) are and remain yours. We will not use this data unless we have explicit permission from you.

We process the following data for the purposes stated in this privacy statement:

a) Register for an account

For certain functionalities of our online store (viewing previous orders and saving address details of recipients) you must first register. By registering you create an account. After registration, we store the personal data you provide via the email address you entered (also your username). We store this information so that you do not have to enter it again each time and so that we can contact you in the context of the execution of the agreement. We store the data as long as you are an active customer with us. If you have not logged in to your account for 7 years, we will delete all your data. In addition, you can request to have your data deleted from your account at any time. You can email this request to info.boxmoments@gmail.com. We are working on a deletion option within the account environment so that you can also submit a deletion request via your account. We will not provide the information linked to your e-mail address entered during registration to third parties, unless this is necessary in the context of the execution of the agreement you conclude with us or if this is legally required. In the event of suspected fraud or abuse of our online store, we may transfer personal data to the competent authorities. If you want to place an order without creating an account, you can also order as a guest. In that case, we process your name and address details and e-mail address. If you choose to register with your Facebook account, boxmoments will receive your email address, first and last name and gender from Facebook (after your permission).

b) Address book
To use direct shipping, you can enter the name and address details of recipients. This data is stored in your account and (just like your own data) only processed in the context of the execution of the agreement: i.e. to send the cards to the recipients.

c) Processing order
When you place an order with us, we use your personal data to process it. If necessary for the execution of the agreement, we can also provide your personal data to third parties, such as a postal company. You can read more about the provision of data to third parties later in this privacy statement: 7. Provision to third parties Without your explicit permission, boxmoments will not provide your personal data to third parties for direct marketing purposes (for example for sending offers). We are legally obliged to keep the data related to your order for 7 years.

d) Analysis
When you visit boxmoments, if you give permission, we collect certain information about you using cookies. We do this, among other things, to increase the user-friendliness of our website and to perform analyzes for reporting purposes. Cookies have a limited retention period and that period differs per cookie. Read more and manage the cookie settings yourself on the cookies page.

e) Marketing
In addition to the information on our website, we can also inform you about our new products and services:

f) Emails
You may receive emails with offers. We will only send you promotional emails with your consent. Would you rather not receive promotional emails anymore? You can unsubscribe via the link in the email or via customer service. If you have given permission to receive personalized emails, we will keep that permission for 5 years. Even if you decide that you no longer wish to receive the emails, we will retain the ability to withdraw your request. We use xx, which is located in the United States, to process your data for sending promotional emails. ActiveCampaign is affiliated with xx.

g) Customer service
We offer the opportunity to ask questions via our online store via a contact form and via WhatsApp, where you will be asked to fill in various details to handle your question. The data you send us will be kept for as long as the nature of the form or the content of your email requires it to be fully answered and processed. If you contact our customer service employees by e-mail because you have questions or complaints about our services, we will store your contact details and your question or complaint. The information collected in this way is used to answer relevant questions, handle complaints and for general statistics to improve our services. At your request, customer service agents can access your card design(s) for the sole purpose of helping you.

boxmoments attaches great importance to good security of your data and takes appropriate technical and organizational measures to protect your data against loss, misuse, unauthorized access and against any (other) form of unlawful processing.

If you have any questions about our privacy statement, you can contact us at any time. You can also send us a request to view, change or delete your data. You can also submit a request for data export for data that we use with your consent, or indicate with reasons that you want us to limit the processing of personal data. To prevent abuse, we may ask you to identify yourself adequately. When it concerns access to personal data linked to a cookie, you must send a copy of the cookie in question. You can find this in the settings of your browser. If the data is incorrect, you can request us to change the data or have it deleted.

Personal data will be retained for the purposes described above (anonymized where possible) for as long as necessary to process orders, including warranty. The data will then be deleted, unless there is a legal obligation that requires longer retention (such as the tax retention obligation of seven years for payment data or the evidentiary obligation of five years for e-mail opt-ins).

Without your explicit permission, boxmoments will not provide your personal data to third parties for direct marketing purposes (for example for sending offers). boxmoments can provide your data to third parties insofar as you have given permission for this with regard to a specific third party and/or insofar as this data cannot be traced back to you personally (such as automatically generated information). boxmoments may provide your data to third parties if we are obliged to do so based on legislation and/or regulations, if we are forced to do so as a result of a lawsuit and/or if we deem this necessary to protect our own rights. We may pass on your data to our partners who are involved in the execution of the agreement, such as a postal company. Social media buttons are included in our online store. The administrators of these services collect your personal data. This privacy statement does not apply to third-party websites that are connected to our online store through links. We cannot guarantee that these third parties handle your personal data in a reliable or secure manner. We recommend that you read the privacy statements of these websites before using these websites.

Of course, we are happy to help you if you have any complaints about the processing of your (personal) data. Under privacy legislation, you also have the right to file a complaint with the Dutch Data Protection Authority against this processing of personal data. You can contact the Dutch Data Protection Authority for this.

We reserve the right to make changes to this privacy statement. We recommend that you consult this privacy statement regularly so that you are aware of these changes.
